These Terms of Service (“Terms”) are an agreement between you and Maadhyamik Technologies Private Limited, a company incorporated under the Companies Act, 2013, with its place of business at BIC@PU, Neithal Salai, Periyar University Campus, Salem 636 011, Tamil Nadu, India (the “Company”, “we”, “us” or “our”). Lexifyd is the Company’s brand for its language learning and language access products.
These Terms apply to your use of:
- our websites, including lexifyd.com; and
- our products and software applications, including the Lexifyd app (mobile and web), Varta Keyboard (mobile apps and browser extensions), Tamil Izhai and Varta Typing Tutor,
referred to individually or together as the “Platform”.
By downloading, accessing or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.
1. Who can use the Platform
You may use the Platform if you can form a binding contract under applicable law.
Children: Lexifyd is designed to help children learn. If you are under 18, you may use the Platform only with the involvement and consent of a parent or guardian. Parents and guardians who allow a child to use the Platform agree to these Terms on the child’s behalf and are responsible for the child’s use, including any purchases.
2. Your account
Some features require an account. You can sign in with a phone number or with Google, Apple, Facebook or Microsoft.
- Please give accurate information and keep it up to date.
- You are responsible for keeping your sign-in details secure and for activity under your account. Tell us promptly at privacy@lexifyd.com if you suspect unauthorised use.
- You can delete your account at any time in the app or at lexifyd.com/delete-account. A deleted account is kept for 30 days: if you sign in again within that time, it is restored and nothing is deleted; otherwise it is permanently removed, as described in our Privacy Policy.
3. Free and paid features
- Free to download: our apps are free to download.
- Lexifyd: some lessons are free after a free registration. Access to the full modules requires a paid subscription. Prices may differ by country and are shown before you buy.
- How you pay: paid access is offered as one-time in-app purchases or as fixed-period subscriptions that do not renew automatically. When a subscription period ends, you can choose to buy again.
- App stores: purchases made in our mobile apps are processed by the relevant app store (such as the Apple App Store or Google Play) under its terms. Refunds are handled under the app store’s refund policy.
- Changes: we may change prices or the features included in free or paid plans. Price changes apply only to future purchases, not to access you have already paid for.
4. Licence to use the Platform
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Platform for your own non-commercial learning and communication, in accordance with these Terms.
You must not:
- copy, modify, distribute, sell or rent any part of the Platform or its content, except as allowed by law;
- reverse engineer, decompile or try to extract the source code of the Platform, except as allowed by law;
- use automated means, such as bots or scrapers, to access the Platform or collect content or data from it;
- interfere with or disrupt the Platform, its security or its servers, or try to gain unauthorised access to any part of it;
- use the Platform for any unlawful, harmful, misleading or abusive purpose; or
- impersonate anyone or misrepresent your connection with any person or organisation.
Schools, organisations and businesses wishing to use the Platform beyond personal use should contact us.
5. Our content and intellectual property
The Platform and its content, including lessons, illustrations, audio, video, games, word lists, keyboard layouts, software, the Lexifyd, Varta and Tamil Izhai names and logos, and the pLexi character, are owned by or licensed to the Company and are protected by intellectual property laws. Except for the licence in section 4, these Terms do not give you any rights in them.
6. Your content and feedback
If you submit content to us, such as messages, reviews or suggestions, you confirm that you have the right to do so, and you grant us a non-exclusive, royalty-free, worldwide licence to use it to operate and improve the Platform. If you give us feedback or ideas, we may use them without any obligation to you.
7. Voice typing and third-party services
Voice typing uses third-party speech recognition services, as described in our Privacy Policy. The Platform may also link to or rely on third-party services, such as app stores, sign-in providers and social media. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.
8. Changes to the Platform
We continually improve the Platform and may add, change or remove features, content or languages. We may also suspend or stop all or part of the Platform. Where a change materially reduces what you have paid for, we will tell you in advance where reasonably possible.
9. Disclaimers
The Platform is designed to support language learning and typing. Learning outcomes depend on many factors, and we do not guarantee any particular result.
To the extent permitted by law, the Platform is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Platform will be uninterrupted, error-free or free of harmful components, although we work hard to keep it reliable and secure.
10. Limitation of liability
To the extent permitted by law:
- the Company is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from or related to your use of, or inability to use, the Platform; and
- the Company’s total liability for any claim relating to the Platform is limited to the amount you paid us for the Platform in the 12 months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnity
To the extent permitted by law, you agree to indemnify the Company against any claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Platform.
12. Suspension and termination
You may stop using the Platform and delete your account at any time. We may suspend or end your access to the Platform if you breach these Terms, if required by law, or to protect the Platform or other users. Sections 5, 6 and 9 to 14 continue to apply after termination.
13. Governing law and disputes
These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms or the Platform is subject to the exclusive jurisdiction of the courts at Salem, Tamil Nadu. Before starting formal proceedings, please contact us so that we can try to resolve the issue informally.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a new “Last updated” date and, where the changes are significant, tell you in the apps or on our website. If you continue to use the Platform after changes take effect, you accept the updated Terms.
